Last updated: January 22, 2025

This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how qelviro ("we," "us," or "our") responds to claims of copyright infringement and how you may submit a notification of claimed infringement. We respect the intellectual property rights of others and expect users of our services to do the same.

1. Overview

In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we have established a process for receiving and addressing notices of alleged copyright infringement. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our services, please notify our designated copyright agent as described below.

2. Notification of Alleged Infringement

To file a notice of infringement with us, you must provide a written communication that includes all of the following elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, a URL or specific page location).
  4. Information reasonably sufficient to permit us to contact you as the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Designated Copyright Agent

Our designated agent for receiving notifications of claimed infringement is:

4. Counter-Notification Procedures

If you believe that material you posted on our services was removed or access to it was disabled as a result of mistake or misidentification, you may file a counter-notification with our designated copyright agent. To be effective, the counter-notification must be a written communication that includes substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the applicable court, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will promptly provide the person who submitted the original infringement notice with a copy of the counter-notification and inform that person that we will replace the removed material or cease disabling access to it in ten business days. We will then replace the removed material or restore access to it within ten to fourteen business days following receipt of the counter-notification, unless our designated copyright agent first receives notice from the person who submitted the original infringement notification that such person has filed an action seeking a court order.

5. Repeat Infringer Policy

We have a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to our services or terminate accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

6. Modifications to Submitted Materials

We reserve the right to modify or remove any content at our discretion, even if it is not the subject of a valid DMCA notice. Nothing in this policy should be construed as legal advice. We recommend consulting a qualified legal professional if you have questions regarding your specific situation.

7. Disclaimer of Warranties

We cannot guarantee that any action taken in response to a notice of claimed infringement will resolve or address all potential copyright concerns you may have. We are not in a position to adjudicate copyright disputes and will act on valid DMCA-compliant notices in good faith.

8. False Notices

Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party who submits a notification of claimed infringement or a counter-notification in bad faith or in violation of applicable law.

9. Acknowledgment

By submitting content to our services, you represent and warrant that you have all necessary rights, licenses, and permissions to do so, and that such content does not infringe the intellectual property rights of any third party. You agree to indemnify and hold harmless qelviro from and against any claims arising out of your submission of content that infringes any third-party intellectual property rights.
